  3. Availability

    1. The user is responsible for fulfilling the necessary technical requirements for contractual use. SYNLAB does not owe the user any such advice.
    2. There is no obligation for SYNLAB to provide the website. SYNLAB does not guarantee the technical availability of the website. In particular, maintenance, security and capacity requirements, in addition to events that are not within SYNLAB's sphere of influence (such as disruptions to public communication networks and power failures) may result in brief malfunctions or temporary interruptions on the website

  7. Limitation of liability
    If the user incurs damages as a result of the use of free services, SYNLAB is only liable in the case of intent (including malice) by SYNLAB.

  8. Severability clause
    If any provision of these Terms of Use is or becomes invalid, this shall not affect the validity of the remaining provisions. A valid provision which most closely reflects the intended economic purpose of the parties shall be deemed as having been agreed in place of the invalid provision.

  9. Applicable law
    These Terms shall be governed by the law of the Federal Republic of Germany, excluding the CISG (UN Convention of Contracts for the International Sales of Goods).

  10. Place of jurisdiction
    If the user is a merchant, legal entity under public law or special fund under public law, the parties hereby agree on Munich as the place of jurisdiction for all disputes arising out of the use of the website, insofar as an agreement conferring jurisdiction is permissible.
